It looks viewable to me.
The DSR should apply because you can cancel at any point until 7 days until after you have recieved the goods - and this includes before delivery.
Curry’s cancelled my order but took the money anyway. HB I've placed a new car deposit of £1000 for a Land Rover Discovery Sport. If the car is registered in September, it has to be EU6d TEMP / WLTP and because it has a PPP I think it will be. I called the Attorney General's office to seek advice (I didn't sign any paperwork and the dealer didn't have the car in stock but I had put a deposit down). Car was sold as having BMW warranty until 2021 and no mentions of any accidents. Deposit refund on new car. You could have claimed damages off them if they hadn't kept the car once the deposit was paid.
I walked into a dealership and paid a $500 deposit and signed an order form for a new car.
Phoned up and spoke over the phone with the dealer. But I was in for a shock! I'm still very doubtful of a full refund leaving them out of pocket if in fact the car has been delivered.Ok.
Due to a change in circumstances, I need to cancel the order. Is what you said!Ok, I can see the difference. He paid late Saturday and cancelled Early Monday so nothing had at the time been done so they couldn't claim an admin fee.
Here's the situation. Again, I know i should have steered clear and I'm expecting some flack for this, but can anybody give me some advice as to whether I have any course of action to take? So with regret I phoned the dealer just as they opened and said that I wanted to cancel my order.
Highly capable off-road. Although your reply is much appreciated you haven't exactly answered my questions or given me any advice on where I stand. This won't be covered under the distance selling regulations, they give you 7 working days to examin the goods and then return if you don't want, even then, you could be liable for the return costs. The following monday morning i found out that i was to be made unemployed.
The dealer said that they were only prepared to refund me £1000 of the £1500 deposit. Will keep you up to date with how I get on First of all - report it to COnsuemr Direct and they will give you further advice. I phoned them today and they are still refusing to refund me. The build date is end of August and delivery is mid-September. in which case it may not apply as they may have already carried the contract out.
I have found links that seem in my favour but cant post them yet!Coniff you replied to the successful case before in 2009. Do distance selling regulations apply in this case? There is nothing unreasonable with that amount.
The total cost after interest that I'd have paid back after 60 months meant I'd have had to pay back £14500. If you would like me to start a new thread please advise. if not then you should demand a return of the full deposit. You are actually under contract to buy the car so whether you can get out of it depends on the dealer.
Never saw the dealer face to face just over the phone.
It is common practice for licensed motor car traders to take a holding deposit for the car when you sign a contract. They told me that no work needed to be carried out and they sold it. The following day I wrote a letter to them to confirm the cancellation and asking for the remaining £500 back as i felt that there was no reason why i shouldn't get it back. Some very quick research seems to indicate that they have seven days to inform the dealer of their inttention to withdraw? I heard of a decent deal for a new car. Today they say they want to deduct £515 for delivery charge to there dealership. I would be happy to make a new thread, I have all y content on the Wayback Machine I will get onto them and try to get the full refund as I find it hard to believe that they could have got it delivered in the 36 hours in wich I ordered and cancelled although I know this has nothing to do with it!One other thing LJJA - were you not told the car had to be collected from some other part of the country? Deposits. Thanks
The fact that no tangible goods were ever received and I cancelled within 48 hours of the original order there should be no issues? I bought a 2018 BMW M140i in February from a used car garage (not BMW). Thank you. All are four-wheel drive and seven-seaters in the UK.The UX 300e, the first fully-electric Lexus, is now available with a 196-mile range.
So basically I've paid them approx £3000 and then they have sold the car but now i have to find £4888 for the privilege of owning a car for a year? I discussed the necessity for Euro6 with the salesman in the initial telephone conversation and was assured that the car is Euro6 so is ULEZ...
A relative of mine very recently left a deposit on a new car via the phone and has since changed their mind.
Am I right in thinking that the deposit has to be returned under the distance selling regulations? I paid a deposit of £1500 over the phone for a car and the car was ordered.
